By accessing or using Thermal ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Thermal is an AI-powered SSH terminal application that allows you to connect to remote servers and automate tasks using natural language commands. The Service includes a desktop application and web-based dashboard for managing your account and connections.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Access systems or networks without authorization
  • Distribute malware, viruses, or other harmful code
  • Engage in any activity that disrupts or interferes with the Service
  • Attempt to gain unauthorized access to other users' accounts
  • Use the AI agent to perform harmful or malicious actions
  • Circumvent any security measures or usage limits

5. AI Agent Usage

The AI agent feature is provided to assist with legitimate server administration tasks. You acknowledge that:

  • You are responsible for reviewing and approving commands before execution
  • AI-generated commands may contain errors and should be verified
  • You must only use the AI agent on systems you are authorized to access
  • We are not liable for any damage caused by AI-generated commands

6. Subscription and Payments

Paid features are billed based on Automation Units (AU) consumed. By subscribing, you agree to:

  • Pay all applicable fees based on your selected plan
  • Provide valid payment information
  • Accept that unused AU do not roll over to the next billing period
  • Accept that fees are non-refundable except as required by law

We reserve the right to modify pricing with 30 days notice to existing subscribers.

7. Intellectual Property

The Service, including its design, code, and content, is owned by Thermal and protected by intellectual property laws. You retain ownership of your data and any scripts or configurations you create using the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may suspend or discontinue the Service for maintenance, updates, or other reasons. We will provide reasonable notice when possible.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES. YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THERMAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless Thermal from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your account if you violate these terms. You may cancel your account at any time through the dashboard. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a reasonable retention period.

14. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.

15. Governing Law

These terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of Australia.
